Crash of a Boeing 737 max 8 of Ethiopian Airlines

The Boeing 737 max 8 of Ethiopian Airlines crashed after take-off. The flight 302 took off from Addis-Abeba on Sunday the 10th of March 12, 2019 heading Nairobi (Kenya). All the 157 passengers and crew died in the accident.

Once again the automatic flight control designed to protect the plane against the stall seem to have caused the crash.

Our experts keep working on the safety issues that this model of Boeing 737 is raising, in the wake of the Lion Air Crash.

Boeing is developing a software which would correct the problems of its product already revealed on the 737 max 8 by the Lion Air case, and the FAA is waiting it in order to issue an Airworthiness Directive (AD) no later than April.

Many air carriers have grounded their fleet of Boeing 737 max 8 and some countries have forbidden this model of aircraft to fly over their territory.

In partnership with American lawyers, our group will help the families to demonstrate the manufacturer’s responsibility in the crash.

LION AIR FLIGHT 610

On the 28th of October 2018, a Boeing 737 max 8 operated by the Indonesian company Lion Air crashed into the sea shortly after take-off on a scheduled flight from Jakarta to Bangka Island, killing all 189 persons on board.

The pilot in command had asked clearance to come back to Jakarta because the plane repeatedly and automatically dived with harsh possibility for the pilots to counter these maneuvers.

The preliminary report seems to demonstrate that the automatic flight control commanded the maneuvers which have been designed to avoid a stall, but in fact this automatic control led to the crash.

MARTIN-CHICO GROUP members and their US partner Edward MONTOYA visited the Indonesian families in order to share with them about their rights and the possible actions to file against the responsible parties, among which the manufacturer Boeing.

Our group is helped by a range of safety aviation experts to determine the exact causes of the crash, beyond what is released by the official investigators. Pursuant to Annex 13 of the Chicago Convention the airline company and the manufacturer are contributing and participating to the investigation, but the families are not part of it..

An important victory for the relatives of the victims of the flight AIR ASIA QZ 8501

Families of the victims of the AIR ASIA QZ 8501 air crash which took place the 28th of December 2014 in the Java Sea just accomplished an important step in their quest of justice.

The French Supreme Court decided on the 28th of November 2018 that the liability of the French manufacturers AIRBUS and its provider ARTUS was not disputable, and that they had to compensate the bereaved families.
In its ruling, the Supreme Court squashes the lower Court (Court of Appeal of Angers) which deemed that because AIR ASIA’s errors in the maintenance was also amongst the causes of the crash it impeded the Court to consider that the obligation of the manufacturers to compensate the victims was undisputable.

“deciding as so, because a third party would have participated to the causes of the accident, and because the manufacturers would have ignored the lack of reliability of the disputed module, although the Court had noted that the defect of the module was amongst the causes of the crash, the court has violated the applicable texts in deciding that the liability of the manufacturers was not be undisputable”

In short the Supreme Court holds the manufacturers liable, and sends back the case to the lower Court for the victims to be compensated.

Crash in Colombia of the charter airplane of the LaMia company

A chartered plane with a Brazilian first division football team crashed near Medellin while on its way from Santa Cruz (Bolivia), killing 71 of the 76 people on board the 29th of November. Due in part to the pilot reporting a lack of fuel, and that the distance between the source and destination airports was very near to, or exceeded, the maximum rated range of the aircraft, it has been speculated that the cause of the crash was fuel exhaustion. The LaMia Insurer seems to pretend that it would not cover the financial consequences of the crash.

Our group expresses its deep condolences to the families and will be ready for any request of help in the aftermath of the tragedy.

Octobre 2016 : Asia QZ 8501

Une nouvelle réunion s’est tenue à Madrid avec les experts de la société ASIC, dans le cadre de l’accident du vol Air Asia QZ 8501. Le rapport privatif établi sera versé au débat judiciaire dans les prochaines semaines.

Des travaux réalisés par les experts, il apparait que si la maintenance du transporteur aérien est en cause, le constructeur de l’A320 sinistré a une part importante de responsabilité dans l’accident qui a coûté la vie aux 162 passagers et membres d’équipage de l’AIRBUS de la compagnie Air Asia, qui reliait l’aéroport de SURABAYA situé en Indonésie, à celui de SINGAPOUR.

Cette responsabilité avait été constatée par le Président du Tribunal de Grande Instance d’Angers, dans sa décision de référé du 14 avril 2016 rendue à la requête de plusieurs familles de victimes défendues par les avocats de “MARTIN-CHICO-GROUP”.

Vueling : des milliers de passagers affectés par les retards et les annulations…

La compagnie à bas coût de droit espagnol Vueling est responsable de l’annulation de plusieurs dizaines de vols depuis le 2 juillet. Des milliers de passagers sont victimes de l’annulation des vols, et ne se sont vus proposer aucune solution de remplacement leur permettant de ne pas subir les conséquences de la désorganisation de leur transporteur. Le règlement (CE) n°261/2004 prévoit une responsabilité automatique du transporteur en cas de retard de plus de deux heures, et une indemnisation minimum allant de 250€ à 600€ selon la distance de vol. Sur démonstration d’un préjudice complémentaire, tel que frais de location, billet de spectacle…ou tout autre préjudice, le transporteur doit également payer. 27 JUIN 2016 : Accident de Puisseguin

Notre groupe a assisté à la réunion du comité de suivi de l’accident de Puisseguin (octobre 2015, 43 personnes décédées),en présence de JULIETTE MEADEL Secrétaire d’Etat chargé de l’aide aux victimes.Les indemnisations obtenues des assureurs ont été jugées très satisfaisantes tant au niveau du montant qu’au niveau des délais d’obtention.C’est une enveloppe de plus de 11 millions d’euros qui a été débloquée par les assureurs.

AIR ASIA QZ 8501 : Rencontre avec les familles des victimes à Surabaya.

1Après la décision du magistrat des référés du Tribunal de Grande Instance d’Angers retenant le principe de la responsabilité des constructeurs AIRBUS et ARTUS dans le crash du vol AIR ASIA QZ 8501, une visite des familles a été organisée afin de leur expliquer les étapes à venir.

3 Juin 2016 DANA AIR : Le AIB (Accident Investigation Bureau) nigérian publie son 4ème rapport intermédiaire qui est vide, comme depuis le 1er rapport intérimaire. Les familles des victimes attendent toujours un hypothétique rapport définitif.
